Breastfeeding Friendly Environments
Advocate for breastfeeding-friendly workplaces.
Legislation has been introduced with the goal of protecting breastfeeding mothers from discrimination and encouraging new mothers to breastfeed. The Breastfeeding Promotion Act would amend the Civil Rights Act of 1964 to protect breastfeeding women from workplace discrimination and provide tax credits for businesses that establish private lactation areas in the workplace. The health care reform legislation that was signed into law by President Obama included a provision that would require employers to provide reasonable accommodations, including a private, clean space and adequate time away from work, in order for women to express breast milk. .

Encourage IRS to allow reimbursement for breastfeeding supplies under FSAs
Currently, items reimbursable under Flexible Spending Accounts (FSAs) include contact lens supplies, over the counter medications, and adhesive bandages. Breast pumps and related equipment are not reimbursable despite the medical necessity for many breastfeeding women who return to work or are otherwise separated from their children. The IRS should include breastpumps and other breastfeeding equipment and supplies as reimbursable expenses under FSAs.
